Justice Matheka, presiding over a Kenyan high court has declared that, being a full time housewife is a job that requires some kind of compensation. This new development was born as a result of a matrimonial property dispute that she handled. She went further to negate the claim that housewives are not financially responsible in the home.

“It is easy for the spouse working away from home and sending money to lay claim to the whole property purchased and developed with that money by the spouse staying at home and taking care of the children and the family. The spouse will be heard to say that the other one was not employed so they contributed nothing.” Justice Matheka said.

The judge further elaborated that, it is improper for housewives to say they don’t have a job because the services performed at home is a full time job and if anyone do not consider it a job, that person should have it outsourced and paid for.

The case that brought about this newest development was the case of a divorced woman who sought to have their family property sold and the money shared equally between she and the ex husband. It was then that Justice Matheka said it was wrong for the value of any spouse to depend on the income they bring into the marriage.

In her words, she reiterated that raising children is a full time job that families pay a person as well as cooking and cleaning. Therefore, for a working mother who needs to balance raising children and doing a full time job should be put into consideration. In buttressing her points, she urged that 9 months pregnancy was to be considered in presiding over cases of matrimonial disputes. 

According to her, 9 months pregnancy is equivalent to working, after all, some couples hire surrogate mothers to bear children for them.
